Chapter 1 General Provisions
Article 1 Purpose of Formulation
To legally safeguard the legitimate rights and interests of students, standardize the student appeal handling procedures, and in accordance with the "Education Law of the People's Republic of China", the "Regulations on the Management of Students in Regular Institutions of Higher Learning" (Ministry of Education Order No. 41), and other laws and regulations, this measure is formulated in light of the actual situation of the school.
Article 2 Definition of Appeal
The appeal referred to in these measures means the act of a student who is dissatisfied with a decision made by the school that involves their rights and interests, or has objections to matters related to campus management, and requests a re-examination from the school's student appeal handling committee.
Article 3 Scope of Application
These measures apply to students who are currently enrolled in the school and receiving regular higher education.
Chapter 2 Appeal Handling Institutions
Article 4 Institution Setup
The school legally establishes a student appeal handling committee (hereinafter referred to as the "committee"), which is affiliated with the student affairs office and is responsible for accepting and reviewing student appeal matters. The committee is accountable to the president's office and reports its work to it.
Article 5 Composition of Personnel
Leadership structure: It has one director (served by the president) and one deputy director (served by the vice president in charge of student affairs).
Members: It includes the heads of the student affairs office, the Youth League Committee, the admissions and employment office, the security office, the vice deans of each college, two teacher representatives, two student representatives (selected by the student union), and the school's legal advisor.
Article 6 Scope of Responsibilities
Accepting student appeal applications.
Reviewing appeal materials and factual basis.
Organizing re-examination meetings or written reviews.
Proposing handling opinions and submitting them to the president's office for deliberation.
Feedback on the appeal handling results.
Guiding the implementation of appeal-related procedures.
Chapter 3 Acceptance of Appeals
Article 7 Scope of Appeals
Students who are dissatisfied with or have objections to the following matters may file an appeal:
Disciplinary decisions made by the school (such as warnings, demerits, probation, etc.);
Decisions to cancel the admission qualification due to late registration or submission of false materials.
Decisions to require withdrawal due to serious violations of school regulations.
Other appealable handling decisions as stipulated by laws and regulations.
Management matters such as campus environment, food safety, accommodation conditions, campus security, infrastructure, and public opinion environment.
Article 8 Time Limit and Materials for Appeals
Time limit requirements: Students must submit a written appeal application to the committee office within 10 working days from the date of receiving the school's handling decision or becoming aware of the matter of objection.
Material requirements:
Appeal letter (including the applicant's basic information, student number, college, and contact information);
Appeal matters, reasons, and demands, along with a copy of the original handling decision of the school.
Relevant evidence materials (such as witness statements, video materials, written proofs, etc.);
Date of appeal and the applicant's signature.
Article 9 Review and Handling of Materials
Acceptance decision: The committee office shall complete the review of the appeal materials within 3 working days after receiving them:
Acceptance: If the materials are complete and fall within the scope of the appeal, a case will be officially filed.
Notice to correct: If the materials are incomplete, a written notice will be issued to the applicant to correct them within 3 working days. Failure to correct within the time limit will be regarded as giving up the appeal.
Non-acceptance: If the applicant does not meet the appeal subject qualification, exceeds the scope of appeal, or fails to correct within the time limit, a written explanation will be issued, and the reasons will be informed.
Handling time limit: A re-examination will be completed within 15 working days from the date of acceptance, and the result will be informed to the applicant in writing or electronically.
Chapter 4 Re-examination Procedures
Article 10 Delivery of Materials and Responses
After accepting the appeal, the committee shall deliver a copy of the appeal letter to the original handling department within 2 working days. The original handling department shall submit a written response within 3 working days after receiving the copy, explaining the handling basis, factual evidence, and legal and school regulations.
Article 11 Review Methods
Written review: Applicable to appeal in matters where the facts are clear, the evidence is sufficient, and the disputes are minor. After reviewing the materials and conducting investigations and verifications, the committee forms a review opinion with the consent of more than two-thirds of all members.
Meeting Review: For complex or highly controversial matters, the committee may hold a re-examination meeting, following the procedures below:
Meeting Notice: The office shall notify the applicant of the meeting time and location three working days in advance. If the applicant is unable to attend due to special circumstances, they must submit a written application for postponement two working days in advance. Whether to postpone is decided by the committee. Absence without cause is regarded as giving up the appeal, and the procedure is terminated.
Application for Recusal: The applicant may apply for the recusal of committee members. The application becomes effective upon approval by the committee chairperson. The vacancy is filled by a substitute member.
Meeting Procedure:
The chairperson introduces the attendees and the agenda.
The applicant states the reasons for the appeal and presents evidence.
The representative of the original handling department explains the basis for the handling.
Both sides cross-examine and debate.
The committee holds a closed-door discussion and votes anonymously (the decision is valid only if more than two-thirds of the attendees agree).
Article 12 Procedure Standards
A re-examination meeting can only be held if more than two-thirds of the members are present. The meeting minutes are archived by the office for future reference. The absence of a representative from the original handling department does not affect the normal conduct of the meeting.
Chapter 5 Re-examination Decision
Article 13 Types and Basis of Decisions
Based on the review results, the committee submits a written opinion to the president's office for deliberation and makes the following decisions:
Maintain the original decision: If the original handling is based on clear facts, correct basis, and legal procedures, it will be maintained.
Revoke or modify the original decision: If the original handling has any of the following circumstances, it will be revoked, or the original handling department will be ordered to make a new decision:
The main facts are unclear, or the evidence is insufficient.
The application is based on incorrect information or violates proper procedures.
There are acts of abuse of power or favoritism.
When re-handling, the original department may not make a decision that is the same as or more severe than the original one.
Article 14 Delivery of Results
The handling decision is delivered to the applicant in the form of a formal school document and copied to the original handling department. If the applicant still has objections to the result, they may appeal to the educational administrative department in accordance with the law.
Chapter 6 Supplementary Provisions
Article 15 Implementation and Interpretation
This method comes into effect from the date of its release and is interpreted by the Student Affairs Office.
Article 16 Disciplinary Requirements
Applicants must provide materials truthfully and may not fabricate facts or maliciously appeal. Violators will be dealt with in accordance with the relevant regulations of the school.
