Regulations on Disciplinary Actions for Students of Guangzhou College of Applied Science and Technology (Trial)

Chapter One General Provisions

Article 1 In order to maintain school order, foster a good school atmosphere and academic style, safeguard the legitimate rights and interests of students, and promote the all-round development of students in terms of morality, intelligence, physical fitness, aesthetics and labor, this regulation is formulated in accordance with the Higher Education Law of the People's Republic of China, the Regulations on the Management of Students in Regular Institutions of Higher Learning, the Code of Conduct for College Students, Several Provisions on the Management of Campus Order in Higher Education Institutions, the Guangdong Province School Safety Regulations and other relevant laws and regulations, in light of the actual situation of our school.

Article 2 This regulation applies to full-time undergraduate students with the student status of our university and those who have reported for enrollment but whose student status is still under review.

Article 3 Students who commit disciplinary violations both on and off campus shall be dealt with in accordance with these measures.

Article 4 Disciplinary violations refer to the acts committed by students that contravene national laws and regulations or the school's rules and regulations, which are detrimental to the school's order or society, and for which disciplinary actions should be taken in accordance with these measures.

Article 5 Students who commit disciplinary violations shall be subject to disciplinary sanctions depending on the severity of the circumstances.

Article 6 The types of disciplinary sanctions are as follows:

(1) Warning;

(2) Serious warning;

(3) Record of demerit;

(4) Probation;

(5) Expulsion from school.

Article 7 Any of the following circumstances shall result in a heavier or aggravated punishment:

(1) Those who play an organizing or leading role in joint disciplinary violations;

(2) Threatening or retaliating against informants or witnesses;

(3) Providing false evidence or colluding with each other to obstruct the handling of disciplinary violations;

(4) Those who repeatedly violate discipline;

(5) Instigating a person under the age of 18 to commit illegal or disciplinary violations;

(6) Where multiple disciplinary violations are committed in a single incident;

(7) The means are extremely vicious, or the consequences are extremely serious.

Article 8 A person may be given a lighter, mitigated or exempted punishment if any of the following circumstances exists:

(1) Voluntarily confessing one's disciplinary violations to the relevant school authorities after committing such violations;

(2) Those who have performed meritorious deeds;

(3) Where justifiable defense or emergency avoidance exceeds the necessary limit;

(4) Violated discipline under duress or deception;

(5) Those who play a secondary or auxiliary role in joint disciplinary violations;

(6) The consequences of the harm are minor;

(7) The victim was at fault;

(8) Where the victim has expressed forgiveness;

(9) Causing damage but making active compensation;

(10) Where there are circumstances such as active restitution of ill-gotten gains, or active cooperation in the investigation of the incident with a demonstrated attitude of repentance, or good conduct and outstanding academic performance, etc., the punishment may be mitigated or reduced at the discretion of the authorities.

Article 9 If a student stops the disciplinary violation before any harmful consequences occur, no disciplinary action shall be taken against him/her. If harmful consequences have occurred, the disciplinary action may be mitigated.

Article 10 A person with intermittent mental illness who causes harmful consequences when unable to recognize or control his or her own behavior and is confirmed through a legal procedure shall not be punished. However, if he or she commits a disciplinary violation when mentally sound, punishment shall be imposed. A person who commits a disciplinary violation due to excessive drinking shall not be exempted from the disciplinary responsibility he or she should bear.

Article 11 If a student violates the Public Security Administration Punishments Law but has not been subject to the penalty procedure of the public security organ, it shall not affect the school's imposition of corresponding disciplinary sanctions in accordance with these measures. If it is verified by the school that the student's behavior is one that should be punished as stipulated in the Criminal Law but has not entered the criminal judicial procedure, it shall not affect the school's imposition of corresponding disciplinary sanctions in accordance with these measures.

Article 12 When making a disciplinary decision against a student, the school shall, based on the facts of the violation, the nature of the behavior, the severity of the circumstances and the degree of harm, impose the penalty in accordance with these regulations, ensuring that the procedures are compliant, the evidence is sufficient, the basis is clear, the characterization is accurate and the penalty is appropriate.

Article 13 Where a student's disciplinary violation is not subject to disciplinary action in accordance with Article 9 or Article 10 of these Measures, or where the circumstances are significantly minor and the student is exempted from disciplinary action, the student's college or relevant department of the school may give the student a verbal criticism, a college-wide public criticism or other written warning.

Article 14 Relevant departments of the school should earnestly carry out ideological education and psychological counseling for students who have violated discipline, offer them due humanistic care, guide them to face up to the facts of their disciplinary actions, and help them correct their mistakes.

Article 15 Where a disciplinary violation causes losses to others, the offender shall bear corresponding civil liability in accordance with the law.

Chapter Two Disciplinary Violations and the Application of Disciplinary Actions

Article 16 Where any of the following circumstances occurs, a warning shall be given depending on the severity of the case:

Serious warning, demerit, probation or expulsion from school:

(1) Those who violate the Constitution, oppose the Four Cardinal Principles, undermine social stability and unity, or disrupt social order;

(2) Violating national laws and committing criminal offenses;

(3) Those who have been punished under public security administration and whose circumstances are serious and nature is heinous;

(4) Taking an exam on behalf of another person or having another person take an exam on one's behalf, organizing cheating, using communication devices or other equipment to cheat, selling exam questions or answers for personal gain, or engaging in other serious cheating or disrupting the exam order.

(5) The degree thesis or publicly published research results involve plagiarism, tampering, forgery or other academic misconduct, and the circumstances are serious; or the thesis is ghostwritten or bought and sold.

(6) Violating the "Regulations on the Management of Students in Regular Institutions of Higher Learning" and the school's regulations, seriously disrupting the normal teaching and educational order, living order, and public place management order of the school;

(7) Infringing upon the legitimate rights and interests of other individuals or organizations and causing serious consequences;

(8) Those who repeatedly violate school regulations and receive disciplinary actions but fail to mend their ways.

Article 17 Those who are punished by judicial authorities shall be subject to the following disciplinary actions:

(1) Students who are administratively detained by the public security authorities or judicially detained by the people's court shall be given a demerit record. Those who are subject to reeducation through labor shall be given a probation or expulsion from school. If probation does not comply with the school's regulations on student status, they shall be expelled from school.

(2) Those who are punished by criminal penalties shall be given a disciplinary sanction of probation or expulsion from school depending on the severity of the circumstances. If probation is not in line with the school's regulations on student status, the sanction of expulsion from school shall be imposed.

Article 18 For fighting, brawling, or provoking trouble, the following penalties shall be imposed:

(1) Those who assault others or engage in mutual fighting without causing injury will be given a serious warning; those who cause minor injuries to others will be given a demerit; those who cause light injuries to others will be placed on probation; and those who cause serious injuries to others will be expelled from school.

(2) Those who plan, incite, instigate, verbally abuse or otherwise offend others to provoke incidents, or those who gang up to fight or collude with outsiders to gang up and fight, or the ringleaders in a fight, or those who fight with weapons, shall be subject to more severe disciplinary actions based on the injury situation or grade as stipulated in item (1) of this article.

(3) Those who, under the pretext of "mediating a fight", take sides, intensify conflicts or cause the situation to escalate without resulting in a fight will be given a serious warning.

(4) Those who do not directly participate in fighting but actively provide fighting tools for others and the fight does not cause injury shall be given a serious warning. If injury is caused, they shall be punished in accordance with term (1) of this article.

Article 19 Those who illegally possess public or private property shall be subject to disciplinary action depending on the nature and circumstances of their behavior.

(1) For theft of public or private property, if the attempt is unsuccessful or the full amount of stolen goods has been returned before the case is discovered, or if the victim has forgiven the offender before the disciplinary decision is made, a warning will be given. If the full amount of stolen goods has not been returned before the case is discovered or if the victim has not forgiven the offender before the disciplinary decision is made, depending on the severity of the circumstances, a warning or a serious warning will be given for cases involving an amount of less than 500 RMB; a serious warning or a demerit will be given for cases involving an amount between 500 RMB and 1,000 RMB; and a demerit, probation, or expulsion will be given for cases involving an amount of more than 1,000 RMB.

(2) Anyone who fraudulently claims another person's remittance or package shall be punished as a thief.

(3) For the act of embezzling public or private property, a warning will be given if the involved amount is less than 1,000 yuan; a serious warning will be given if the amount is between 1,000 yuan and 3,000 yuan; and depending on the severity of the circumstances, a demerit, probation or expulsion from school will be imposed if the amount is over 3,000 yuan.

(4) For those who commit fraud, if they have obtained the victim's forgiveness before the disciplinary decision is made, they shall be given a warning. If they have not obtained the victim's forgiveness, they shall be given a warning, a serious warning, demerit, probation or expulsion from school based on the amount involved as stipulated in item (1) of this article and the severity of other circumstances. Where there is no amount involved, the other standards as stipulated in the judicial interpretations of the Supreme People's Procuratorate and the Supreme People's Court shall be applied.

(5) Those who steal official seals, confidential documents, archives or other items shall be given a disciplinary sanction ranging from a demerit to expulsion from school, depending on the severity of the circumstances.

(6) Those who commit robbery, looting, snatching, blackmail or kidnapping shall be given a disciplinary probation or expelled from school depending on the severity of the circumstances.

(7) Anyone who provides assistance for the disciplinary violations listed in items (1) to (6) above, or who purchases, harbors, destroys or transfers stolen goods knowing them to be such, shall be regarded as having committed a joint disciplinary violation. The school will impose a disciplinary sanction of warning, serious warning, demerit, probation or expulsion, depending on the nature and severity of the violation.

Article 20 For climbing public facilities and damaging public or private property, the following disciplinary actions will be taken depending on the severity of the circumstances:

(1) Those who intentionally damage public or private property shall be given a serious warning, demerit, probation or expulsion from school, and shall be ordered to compensate for the losses.

(2) Whoever negligently damages public or private property and compensates for the economic losses shall be exempted from sanctions; Those who refuse to make compensation and cause conflicts shall, depending on the seriousness of the circumstances, be given a warning, serious warning or demerit.

(3) Those who climb over the school fence to enter or leave the campus will be given a public reprimand depending on the severity of the circumstances. In more serious cases, they may be given a warning, a serious warning, demerit, or be placed on probation.

Article 21 Any infringement upon personal rights shall be subject to disciplinary action depending on the nature and circumstances of the act.

(1) Those who use the names or identities of others (including IP addresses or email addresses) without authorization and cause harmful consequences will be given a serious warning, demerit, probation or expulsion from school, depending on the severity of the circumstances.

(2) Insulting, abusing, defaming, framing, falsely accusing, illegally detaining or confining others will be subject to a serious warning, demerit, probation or expulsion from school, depending on the severity of the circumstances.

(3) Anyone who illegally detains, conceals, destroys, misappropriates or privately opens others' mail will be given a warning, a serious warning, a demerit or be placed on academic probation depending on the severity of the circumstances.

(4) Peeping, taking photos of others secretly, eavesdropping, spreading or otherwise infringing upon others' privacy will be subject to a serious warning, demerit, probation or expulsion from school, depending on the severity of the circumstances.

(5) Those who insult women or commit other indecent acts against others shall be given a serious warning, demerit or probation depending on the severity of the circumstances; those with extremely bad circumstances shall be expelled from school.

Article 22 Those who forge, alter, or sell various certificates, seals, and proof documents or materials shall be given a serious warning, demerit, probation, or expelled from school depending on the severity of the circumstances.

Article 23 Those who gamble by mahjong, poker, chess or any other means (including the Internet) or gamble in disguised form shall be given a warning, a serious warning, a demerit record or a school probation according to the seriousness of the circumstances; Those who gamble in public places, or who organize gambling or provide gambling places, or repeat offenders, shall be subject to detention or expulsion from school.

Article 24 Anyone who produces, duplicates, disseminates, or views obscene, violent or terrorist audio-visual or written materials, or visits illegal web pages that are harmful, shall be subject to the following disciplinary actions depending on the severity of the circumstances:

(1) Anyone who writes or draws obscene, violent, terrorist or other unhealthy words or images inside or outside the school will be given a warning, a serious warning or a demerit record.

(2) Organizing or participating in the viewing or browsing of pornographic, violent terrorist or illegal and harmful audio-visual or textual materials or internet web pages with two or more people will result in a serious warning, demerit, probation or expulsion from school.

(3) Those who produce or disseminate obscene, violent and terrorist or other illegal and harmful materials shall be given a disciplinary sanction of demerit, probation or expulsion from school.

Article 25 Anyone who engages in improper sexual behavior with others and causes adverse effects shall be given a serious warning, demerit or probation depending on the severity of the circumstances. Those who engage in prostitution, solicitation or act as an intermediary for such activities shall be given probation or expelled from school.

Article 26 Anyone who sells, uses, provides or privately keeps drugs or prohibited medicines shall be subject to the following disciplinary actions depending on the severity of the circumstances:

(1) Students who engage in smuggling, trafficking, transporting or manufacturing drugs shall be expelled from school.

(2) Students who incite, coerce or deceive others into taking drugs or provide places for others to take drugs shall be expelled from school.

(3) Depending on the seriousness of the circumstances, students who ingest or inject drugs shall be given the sanction of probation or expulsion from school.

(4) Illegal use, purchase, possession or sale of prohibited drugs shall be subject to disciplinary actions ranging from a warning to expulsion from school, depending on the severity of the offense.

Article 27 Students who participate in pyramid schemes or disguised pyramid schemes shall be given a warning, a serious warning, a demerit or a probation depending on the severity of the circumstances. Those who organize or coerce, deceive or induce others to participate in pyramid schemes or disguised pyramid schemes shall be expelled from school.

Article 28 Those who have illegal or rule-breaking driving behaviors shall be subject to the following disciplinary actions depending on the severity of the circumstances:

(1) Students who drive motor vehicles after drinking alcohol will be given a disciplinary probation; those who drive under the influence of alcohol will be expelled from school without exception.

(2) Those who drive motor vehicles without a license on campus and refuse to heed warnings will be given a warning or a serious warning. If a traffic accident occurs without causing any casualties, a demerit will be imposed. If casualties are caused, depending on the severity of the circumstances, the student will be placed on academic probation or expelled from school.

(3) Those who drive motor vehicles in violation of regulations on campus and refuse to heed warnings will be given a warning or a serious warning. If casualties are caused, depending on the severity of the circumstances, they will be given a disciplinary probation or expelled from school.

Article 29 Those who violate the relevant regulations of Xuesiyuan and disrupt its management and order shall be subject to the following disciplinary actions depending on the severity of the circumstances:

(1) Those who engage in behaviors such as throwing objects from heights and disrupting the management order of Xuesiyuan will be given disciplinary actions ranging from a demerit to expulsion from school depending on the severity of the situation. In cases of serious circumstances, they will be handed over to judicial authorities for handling.

(2)Those who change, occupy, defraud or rent dormitories or beds without approval shall be given severe warning according to the seriousness of the circumstances; In serious cases, students shall be expelled from school.

(3) Those who accommodate people from outside the campus without approval and fail to correct their behavior despite repeated warnings, and cause adverse consequences, will be given a serious warning, demerit or probation depending on the severity of the situation; if the consequences are particularly serious, they will be expelled from school.

(4) Those who allow non-residents to stay overnight in their dormitory and cause adverse consequences will be given a warning, a serious warning or a demerit record depending on the severity of the situation.

(5) Those who stay overnight in the opposite sex's dormitory or allow the opposite sex to stay overnight in their dormitory will be given a warning, a serious warning, demerit or probation depending on the severity of the situation; if serious consequences are caused, they will be expelled from school.

(6) Students who rent apartments off campus without approval and fail to correct their behavior despite repeated admonitions will be given warnings, serious warnings or demerits depending on the severity of the situation. Students who rent houses off campus without approval shall bear all the consequences arising therefrom on their own.

Those who keep pets in Xuesiyuan and fail to correct their behavior despite repeated warnings will be given a warning, a serious warning or a demerit record depending on the severity of the situation.

(8) For students who are required to live on campus and frequently return late or fail to return at night without approval, the following disciplinary actions will be taken depending on the circumstances.

Students who return late: Those who return late between 23:00 and 06:00 from Sunday to Thursday or between 00:00 and 06:00 on Friday and Saturday will be subject to criticism and education or a warning depending on the severity of the situation. Those who repeatedly fail to correct their behavior will be given a serious warning up to a disciplinary probation. In cases of serious circumstances, they will be given a demerit up to expulsion from school. Students who do not return to the dormitory at night will be held fully responsible for all consequences caused thereby and will be given a demerit up to expulsion from school depending on the severity of the situation.

(9) Those who store wine bottles in Xuesiyuan, drink too much alcohol and cause bad influence in school will be given warning or severe warning according to the seriousness of their circumstances; Those who fail to change after repeated teaching shall be given demerit demerit to expulsion from school according to the seriousness of the circumstances.

(10) Those who gamble, fight or engage in other activities that disrupt the normal living order of others in the public areas of Xuesiyuan will be given a warning to a serious warning depending on the severity of the situation; if serious consequences are caused, they will be given a demerit or a more severe punishment depending on the circumstances.

(11) If the lights on the balcony of the dormitory are not turned off at the designated time without special reasons, the offender will be given a notice of criticism within the college. If the offense is repeated despite warnings, the offender will be given a warning up to a serious warning depending on the severity of the case.

(12) For those who maliciously create noise in the dormitory after the lights-out time, affecting others' study and rest and being reported, they will be given a disciplinary notice of criticism and education within the college depending on the severity of the situation; for those who talk loudly, make noise, or cause commotion in the public areas of Xuesi Garden, or engage in entertainment, visit other dormitories, use audio equipment, or conduct other activities that affect others' study and rest, they will be given a serious warning depending on the severity of the situation; those who repeatedly fail to correct their behavior despite repeated admonishments will be given a disciplinary record or placed on probation depending on the severity of the situation.

(13) Those who smoke in the public areas of Xuesiyuan, randomly pile up garbage at the dormitory entrances, or casually dump tea leaves and other food residues into the drainage outlets of the public drinking water dispensers in Xuesiyuan will be given a warning to a demerit record depending on the severity of the offense.

(14) Anyone who scribbles, draws, writes or posts things randomly on the walls, doors, windows, desks, chairs or other public facilities in Xuesiyuan without approval will be given a serious warning, demerit or placed on probation depending on the severity of the offense. The person will also be required to restore the original appearance of the affected area. If any damage is caused, the person will be required to compensate for it at the original price.

(15) Anyone who climbs over the balcony of Xuesi Garden, scales the wall or the anti-theft net to enter the garden shall be held fully responsible for all consequences. Depending on the severity of the circumstances, they will be subject to public criticism, warning, serious warning, demerit or probation.

(16) Setting off firecrackers or burning letters, waste paper, sundries, etc. in Xuesiyuan will result in disciplinary actions ranging from a public censure to a probation depending on the severity of the offense.

(17) Anyone who carries valuable items or travel bags in and out of Xuesiyuan and refuses to be inspected by the life guidance teacher will be given a notice of criticism, warning or serious warning depending on the severity of the situation.

(18) Without approval, engaging in commercial activities on campus privately, including selling cigarettes, alcohol, snacks, beverages and other items, purchasing on behalf of others, running errands for others, photocopying and printing, distributing flyers and other profit-making activities, will be subject to a serious warning, demerit or probation depending on the severity of the situation. In serious cases, the student will be expelled from school.

(19) Other violations of the management regulations of Xuesiyuan will be subject to warnings, serious warnings, demerits or probation depending on the severity of the circumstances.

Article 30 Any violation of electricity usage regulations within Xuesiyuan, including the storage or use of electric kettles, rice cookers, electric stoves, electric cups, induction cookers, electric hot pots, electric heating rods, electric irons, hair dryers (over 800W), hair curling irons, dryers, refrigerators, printers, electric blankets, egg steamers, health care pots and other electric heating appliances and kitchenware, random wiring, socket installation, purchase and use of "three-no" (no Chinese labels, no factory name, no factory address) products, substandard products, inferior products, illegal use of open flames, storage of flammable, explosive, corrosive, highly toxic and radioactive dangerous goods, and causing accidents, will be subject to serious warnings, demerits or probation depending on the severity of the offense. In serious cases, the student will be expelled from school. If the violation constitutes a crime, the case will be handed over to the public security authorities for handling.

Article 31 Students should take good care of the facilities and furniture of Xuesiyuan. They are not allowed to dismantle, modify, change the door locks or move the facilities and furniture of Xuesiyuan. Facilities and equipment, furniture, firefighting equipment, direct drinking water fountains and other public area facilities and equipment in the dormitory are naturally damaged, and they shall be replaced or repaired by the logistics and assets departments. If facilities, equipment and furniture are damaged or lost due to improper use, compensation shall be made according to the price; Intentional damage, serious circumstances shall be given a serious warning, demerit or detention. Warning, serious warning or demerit punishment shall be given to those who lend the key to non-dormitory staff and cause property damage.

Article 32 Anyone who refuses, obstructs or hinders staff members from performing their duties in accordance with the law or school regulations shall be given a serious warning, demerit or probation. If serious consequences are caused, the student shall be expelled from school. Anyone who threatens, intimidates, coerces or retaliates against staff members in any way shall be subject to a more severe punishment.

Article 33 Those who maliciously call special emergency numbers or the emergency duty phone numbers of schools will be given a serious warning, demerit or probation depending on the severity of the circumstances.

Article 34 Those who fabricate or spread rumors shall be given a warning, a serious warning, demerit or probation depending on the severity of the circumstances.

Article 35 Anyone who, without approval, privately creates or spreads versions of the school name or school motto in a manner that disrupts the school order, will be subject to disciplinary action, including a warning, a serious warning, a demerit or be placed on probation, depending on the severity of the circumstances. In particularly serious cases, the individual may be expelled from the school.

Article 36 Anyone who uses an aircraft without approval and thereby affects large-scale school events, normal teaching, scientific research or daily life order shall be given a serious warning, demerit or placed on probation depending on the severity of the circumstances; in serious cases, the case will be handed over to the public security authorities for handling.

Article 37 Students who illegally possess prohibited or controlled items as explicitly stipulated by national laws and regulations on campus shall be subject to disciplinary actions ranging from a warning to expulsion, depending on the severity of the circumstances. If the prohibited items fall under the categories listed in Article 26 of this regulation, the corresponding disciplinary measures as stipulated in that article shall be imposed. If the items are obscene but no disciplinary violations as listed in Article 24 of this regulation have occurred, a warning shall be given.

Article 38 Anyone who resorts to fraud to obtain school scholarships, grants or hardship allowances shall be subject to the disciplinary measures stipulated in Article 19 for acts of fraud.

Article 39 If a student lends his/her student ID card, ID card, campus card, IP address or email address to others for use, causing losses to the school or a third party or other serious consequences, in addition to compensating for the losses, he/she shall be given a warning, a serious warning or a demerit record.

Article 40 Anyone who violates campus management regulations by organizing or participating in the posting or distribution of commercial promotional materials, setting up illegal stalls or organizing other types of profit-making activities will be given a warning or a serious warning upon discovery and receive relevant education. Those who fail to correct their behavior despite repeated admonishments will be given a demerit or a more severe punishment. If serious consequences are caused, the student will be placed on probation or given a more severe punishment.

Article 41 Anyone who violates the national and school regulations on network management and disrupts the network management order shall be subject to the following disciplinary actions depending on the circumstances:

(1) Anyone who privately provides the school's network interface to others and accepts money or goods, or causes adverse consequences, will be given a disciplinary sanction ranging from a warning to expulsion from school, depending on the severity of the circumstances.

(2) Those who post various harmful information through the Internet and whose actions comply with other provisions of this measure shall be punished in accordance with the relevant provisions.

(3) Those who create or deliberately spread computer viruses will be given a serious warning. Those who cause paralysis or damage to the network system will be given a demerit, placed on academic probation or expelled from school, and ordered to repair the damage or compensate for the losses.

(4) Those who illegally delete, modify or add the functions of the school computer information system or the data and application programs stored, processed or transmitted in the information system shall, depending on the seriousness of the circumstances, be given serious warning, demerit record, detention or expulsion.

(5) Violating the laws and regulations concerning the management of the Internet at the national level or other relevant regulations of the school's campus network, depending on the severity of the offense, the offender will be given a warning, a serious warning, demerit, probation or expulsion from school.

(6) Those who repeatedly fail to correct their behavior of creating, copying, consulting or spreading false, bad or illegal information through the Internet will be given a warning or a more severe punishment.

Article 42 Students who violate the code of ethics for citizens and the code of conduct for college students, have a bad character and fail to mend their ways despite repeated admonitions shall be given a warning, a serious warning, a demerit, probation or expelled from school depending on the severity of the circumstances.

Article 43 Students who violate the attendance rules will be dealt with accordingly based on the total number of class hours they are absent in one semester:

If a student accumulates 20 or fewer class hours of absence, the student's college will issue a written criticism.

A warning will be given for 21 to 30 class hours of absence.

A serious warning will be given for 31 to 40 class hours.

A student who accumulates between 41 and 50 hours of absence will be given a demerit.

Students who have accumulated more than 51 class hours of absence (including 51 hours) will be given a disciplinary probation. Those with serious circumstances will be treated as having withdrawn from school automatically.

Article 44 Students who organize, engage in or accept substitute classes will be given a serious warning up to probation depending on the severity of the circumstances.

Article 45 Students who violate examination discipline or cheat in examinations shall be dealt with in accordance with the relevant regulations of the school on handling examination disciplinary violations.

Article 46 Students who publish relevant information on behalf of the exam, writing papers or homework shall be given a warning or serious warning according to the seriousness of the circumstances; Those who write papers for them shall be given demerit; Those who sell their papers shall be given the punishment of being placed under observation and their income from disciplinary violations shall be confiscated; Students who purchase theses shall be given the sanction of expulsion.

Article 47 Anyone who plagiarizes others' research achievements or articles shall be given a warning, a serious warning, a demerit or be placed on probation. Anyone who engages in fraudulent behavior such as forging data and operation procedures shall be given a demerit or be placed on probation. In cases of particularly serious circumstances, the student shall be expelled from school.

Article 48 Students who are married before enrollment must, within five working days from the date of enrollment, and students currently enrolled (including those on leave of absence or suspension) must, within five working days from the date of obtaining a legal marriage, go through the registration procedures with the part-time family planning staff of their respective colleges through their class advisors or counselors, and accept the school's family planning management. Those who fail to do so will be given a demerit. Those who still fail to register and accept the school's family planning management after criticism and education will be given a probationary suspension.

Article 49 Students who violate the family planning laws and regulations of the People's Republic of China by having children out of wedlock, without a permit, or abroad, causing the school to bear responsibility, or who refuse to accept the school's legal management of family planning after becoming pregnant, or who illegally adopt children, shall be expelled from school.

Article 50 For acts that disrupt the management order of epidemic prevention and control on campus, the following measures shall be taken depending on the circumstances:

(1) If a student shows suspected symptoms such as fever, fatigue, dry cough or diarrhea but fails to report the abnormal physical condition to the school voluntarily, or conceals, omits or misreports such information, once verified, disciplinary actions ranging from a demerit record and above will be imposed depending on the circumstances.

(2) Anyone who conceals their contact history with confirmed or suspected patients, or with people returning from abroad, or their personal medical history, or who makes false or incomplete reports of such information, will be subject to disciplinary action of a demerit or higher once verified.

(3) Those who spread rumors or false information related to the epidemic through letters, mobile phones, the Internet or other means of communication, attack others or relevant institutions, infringe on the rights and interests of others, or directly intimidate or threaten the safety of others, interfere with the normal life of others, and cause serious consequences, shall be given demerit or above, depending on the circumstances.

(4) If a student refuses to cooperate or fails to abide by the regulations during the quarantine period when quarantine measures are deemed necessary in accordance with relevant provisions, a disciplinary sanction of a demerit or above will be imposed.

(5) Any other circumstances that hinder or interfere with the school's epidemic prevention and control work, or cause adverse effects or harm to the health and safety of all teachers and students on campus, will be subject to disciplinary actions ranging from a warning and above depending on the severity of the situation.

(6) Students who refuse to cooperate with or fail to abide by the order at the nucleic acid testing site as stipulated by relevant regulations will be given a disciplinary sanction of demerit or above.

(7) During the epidemic, if students leave school without approval, they will be criticized within the college depending on the severity of the situation. Those with serious circumstances will be given a warning or a serious warning.


Chapter Three Procedures for Disciplinary Actions

Article 51 After a disciplinary violation occurs, each secondary college should promptly complete the investigation and evidence collection work. For general student disciplinary violations, the investigation and evidence collection shall be conducted by the secondary college where the student is located. For student disciplinary violations involving multiple secondary colleges, the Student Affairs Office or the Academic Affairs Office (responsible for handling examination violations) shall coordinate and the relevant secondary colleges shall conduct the investigation and evidence collection.

Article 52 For disciplinary violations involving public security or criminal matters, the Security Department shall conduct investigations and collect evidence in conjunction with the secondary college where the student is enrolled. For cases that should be transferred to the public security authorities for handling or have already been filed by the public security authorities, the Security Department shall transfer the cases or assist the public security authorities in conducting investigations and collecting evidence in conjunction with the secondary college where the student is enrolled.

Article 53 Investigators shall protect the privacy and other legitimate rights and interests of the persons under investigation. Investigators who have a stake in the case shall recuse themselves.

Article 54 Investigators shall conduct a comprehensive, objective, meticulous and in-depth investigation and inquiry into all the facts of the case, including the time and place of the incident or event, the parties involved and the persons concerned, the entire course of the act, the causes and consequences, the motives and purposes, and all the circumstances.

Article 55 The investigators shall make a record of the investigation. The record shall state the basic information of the investigators and the person under investigation. After the investigation is completed, the record shall be given to the person under investigation for verification. If there are any errors or omissions in the record, the person under investigation shall be allowed to make corrections or additions, and sign or affix his or her seal at the place of correction or addition. After the record has been verified to be correct, the person under investigation shall sign or affix his or her seal on each page and indicate the date. If the person under investigation refuses to sign or affix his or her seal, the investigators shall note the situation in the record and sign or affix their seals; or one investigator and one witness shall sign or affix their seals and indicate the date.

Article 56 Relevant departments shall pay attention to collecting evidence, indicate the source and origin of the evidence, and take care of the preservation of the evidence.

Article 57 The following evidence, after being verified and confirmed, may be used as the basis for disciplining students who have violated discipline:

(1) Documentary evidence;

(2) Physical evidence;

(3) Testimony of witnesses;

(4) Statements of the parties;

(5) Audio-visual materials;

(6) Expert conclusion;

(7) Inspection, examination or on-site record;

(8) Rulings, judgments, appraisals of judicial organs, and decisions of relevant departments;

(9) Other materials with evidential value.

Article 58 Before imposing disciplinary sanctions on a student suspected of violating discipline, the student or his/her agent should be given the opportunity to make a statement and present a defense. The statement and defense of the student or his/her agent should generally be submitted in writing. A student has the right to entrust his/her close relatives, lawyers, or law students from our school as his/her agent.

Article 59 After discovering a student's violation of discipline or receiving a report of such violation, the college or other investigation department shall complete the investigation and collection of evidence within 10 working days and, on the basis of ascertaining the facts, propose a handling suggestion. For major or complex cases, the period for investigation and collection of evidence may be appropriately extended.

Article 60 After receiving the investigation materials or handling suggestions from the college or other investigation departments, the Student Affairs Office or the Academic Affairs Office shall verify them within 7 working days and put forward the initial handling opinions.

Article 61 The college or other investigation department shall submit the following materials to the Student Affairs Office or the Academic Affairs Office:

(1) A handling suggestion signed by the leader of the college or other investigation department and stamped with the official seal;

(2) Comprehensive materials on students' disciplinary violations provided by the college or other investigation departments;

(3) Investigation Record;

(4) Written statements or self-criticisms by the parties involved;

(5) Other relevant evidence materials.

Article 62 Approval Procedures and Authority for Disciplinary Actions:

(1) If students are given demerit notes or the following punishments, they shall be studied and drafted by the secondary colleges and sent to the Student Affairs Office or the Academic Affairs Office for review and approval, and reported to the school leaders in charge for approval;

(2) For students who are to be given a disciplinary probation or expelled from school, the respective secondary colleges shall put forward handling suggestions, which will be submitted to the Student Affairs Office or the Academic Affairs Office for review and then presented to the Party and administrative joint meeting for discussion and approval.

Article 63 Before imposing a disciplinary sanction on a student who has violated discipline, the student shall be informed of the facts, reasons and basis for the proposed sanction, and shall be informed of his or her right to make a statement and to defend himself or herself.

Article 64 When a disciplinary sanction is imposed on a student for violation of discipline, a notice of disciplinary sanction shall be issued. The notice of disciplinary sanction shall include the following matters:

(1) The student's name, gender, the secondary college they belong to, grade, major, and class, etc. of the disciplined student;

(2) The relevant facts of disciplinary violations and evidence as determined;

(3) Reasons and basis for the applicable disciplinary action;

(4) The type of disciplinary action taken and the duration of the disciplinary period;

(5) The channels and time limit for students who have been disciplined to file an appeal;

(6) Determine the seal of the unit and the date of decision, as well as other necessary contents.

Article 65 The notice of disciplinary actions such as warnings, serious warnings and demerits against students shall be issued by the Student Affairs Office or the Academic Affairs Office, as authorized by the school.

The notice of disciplinary actions such as probation and expulsion of students is issued by the school.

Article 66 The notice of disciplinary action shall be in duplicate (one page with two parts, the upper part being the receipt). One copy shall be given to the student who is subject to the disciplinary action, and the other copy shall be kept on file by the school.

Article 67 The notice of punishment must be sent by the college, and other teachers or students are required to attend the scene as witnesses. The students who are punished should sign and date the decision. If the punished student refuses to sign, the delivery person shall record the reason and date of the student's refusal on the return certificate of service, the delivery person and the witness shall sign or seal, and decide to leave the letter with the punished student Office, which shall be deemed to have been served.

Article 68 Where it is difficult to deliver the notice of disciplinary action directly, the following methods may also be adopted for delivery:

(1) Personal service. When the college dispatches a server and a witness to directly deliver the disciplinary notice to the student subject to discipline, if the student is not present, the notice may be signed for by his or her parents or adult relatives living in the same household. If the student's parents or adult relatives living in the same household refuse to sign for the disciplinary notice, the server and witness shall record the reasons for the refusal and the date on the service return receipt, sign or affix their seals, and leave the disciplinary notice at the student's residence or the receiving and dispatching department, which shall be deemed as service.

(2) Mailing for Delivery. When it is truly difficult to deliver the disciplinary notice directly, it can also be sent by registered mail or express delivery to the student subject to the disciplinary action at the address confirmed by the student. A delivery receipt should be attached when mailing for delivery. If the date of receipt indicated on the registered mail receipt is inconsistent with that on the delivery receipt, or if the delivery receipt is not returned, the date of receipt indicated on the registered mail receipt shall be regarded as the date of delivery.

(3) Service by Public Announcement. If the above methods are ineffective, an announcement will be made within the school premises (including online announcements). The announcement will be deemed to have been served two weeks after its publication. The school will truthfully record the announcement and have it signed by two witnesses.

Article 69 The disciplinary decision shall be announced in a timely manner within the entire school, the secondary college or the class as appropriate, and a written notice shall be sent to the parents. The decision on whether to announce the disciplinary decision involving personal privacy or state secrets shall be made by the Student Affairs Office or the Academic Affairs Office. The notice of expulsion from school shall be filed with the Department of Education of Guangdong Province at the same time.

Chapter Four Appeals

Article 70 If a student has any objection to the disciplinary decision, he/she may submit a written appeal to the Student Appeal Committee of the school within 10 days from the date of receiving the disciplinary notice. The specific contents, procedures of the appeal and the way the Appeal Committee handles the appeal are stipulated in the "Implementation Measures for Student Appeals of Guangzhou College of Applied Science and Technology".

Article 71 The Student Grievance Review Committee shall re-examine the grievances raised by students and make a review conclusion within 15 days from the date of receiving the written grievance and inform the student concerned. If the situation is complex and a conclusion cannot be reached within the prescribed period, the extension of 15 days may be granted upon approval by the Party and administrative joint meeting submitted by the principal in charge. If the original disciplinary decision needs to be changed, the Student Grievance Review Committee shall submit it to the department that made the original disciplinary decision or the Party and administrative joint meeting for re-examination and decision. From the date of delivery of the disciplinary decision or the review conclusion, if a student fails to file a grievance within the prescribed period, the school will no longer accept the grievance.

Article 72 If a student has objections to the school's re-examination decision, he/she may file an appeal with the Department of Education of Guangdong Province within 15 days from the date of receiving the school's re-examination decision.

Chapter Five Warning, Documenting and Implementing Disciplinary Actions for Violations

Article 73 Warning scope for students' disciplinary violations:

(1) Students who have committed petty theft but can voluntarily admit their mistakes upon discovery and have a relatively deep understanding of their actions;

(2) For those who have caused minor damage to state or others' property (excluding damage to fire protection, power, communication facilities and network systems), without causing serious consequences and are willing to compensate at the original price and have a deep understanding of their own behavior;

(3) Those who have accumulated 16 or more hours of absence without leave;

(4) Those who do not abide by classroom discipline and show disrespect to teachers, causing certain influence;

(5) Those who return home late or start staying out overnight;

(6) Those who stay up all night surfing the Internet and affect others' study and life;

(7) Paranoia in behavior, although there are violations of school regulations, the circumstances are significantly minor and do not warrant disciplinary action or may be exempted from such action.

Article 74 Handling and Function of Student Disciplinary Warning:

(1) For students within the warning range, counselors should conduct ideological education, proactively talk to the students and make written records;

(2) Points may be deducted from the comprehensive assessment score of students who receive a warning, as appropriate;

(3) On the basis of verifying the facts of the error, and in combination with the student's understanding of the mistake committed, the relevant student will be given oral criticism, written warning and public censure by a designated person from the student's secondary college.

(4) Implement a student disciplinary warning system, which serves to remind students and help them avoid more serious consequences as much as possible.

Article 75 All disciplinary actions against students shall be issued in the name of Guangzhou College of Applied Science and Technology.

Article 76 Procedure for Drafting Documents:

(1) For disciplinary actions below probation, the student's secondary college shall draft the disciplinary decision, which will be reviewed and filed by the Student Affairs Office or the Academic Affairs Office. After being signed by the responsible school leader, it will be issued in the form of a "Guangzhou College of Applied Science and Technology Document". The disciplinary decision and related materials shall be filed with the Student Affairs Office or the Academic Affairs Office.

(2) If the student is placed on probation or expelled from school, the secondary college where the student is located will put forward suggestions for handling the case, the Student Affairs Office or the Academic Affairs Office will review it, and the joint meeting of the Party and government of the school will study and decide on it, and issue a document in the form of "Guangzhou College of Applied Science and Technology". And reported to Guangdong Provincial Department of Education for the record.

Article 77 Management of Disciplinary Materials and Documents:

(1) Materials related to students' disciplinary actions and their removal shall be truthfully and completely filed in the students' personal files by the secondary college where the students are located.

(2) The documents concerning students' disciplinary actions and their removal shall be filed and archived in accordance with the unified requirements of the school's documents for both the school's official archives and the students' personal files.

Chapter Six Supplementary Provisions

Article 78 The Student Affairs Office and the Academic Affairs Office, authorized by the school, are responsible for the interpretation of these measures.

Article 79 These Measures shall come into effect as of the date of promulgation.
